Terms of Service

These Terms of Service ("Terms") govern your access to and use of ScaleNova CRM (the "Service"), operated at https://crm.scalenova.co.in. By creating an account or otherwise using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent.

1. The Service

ScaleNova CRM is a CRM for sales teams: lead capture from multiple channels, click-to-call telephony, workflow automation, and reporting. Some features depend on optional third-party integrations (telephony providers, Google Sheets, Meta Lead Ads, WhatsApp via AiSensy, Razorpay) that your organization connects and configures itself.

2. Accounts and eligibility

You must provide accurate information when registering and are responsible for keeping your login credentials confidential and for all activity under your account. You must be legally able to enter into a binding contract to use the Service.

3. Your organization's data

Your organization retains all rights to the lead, contact, and business data it stores in the Service ("Customer Data"). We only process Customer Data to provide the Service to your organization, as described in our Privacy Policy. Your organization is responsible for having the right to collect and store the Customer Data it enters, including obtaining any consent required to record calls where call recording is enabled.

4. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Send unsolicited communications (spam/robocalls) in violation of applicable telecom or messaging regulations.
• Upload data you don't have the right to collect or share.
• Attempt to gain unauthorized access to the Service or another organization's data.
• Reverse-engineer or resell the Service without our written permission.

5. Third-party integrations

Features that connect to a third-party provider (a telephony provider, Google, Meta, AiSensy, Razorpay, or an AI provider) are governed by that provider's own terms in addition to these. We aren't responsible for the availability, accuracy, or acts of those third parties.

6. Fees

Pricing is being finalized directly with each organization (see sales@scalenova.co.in). Where a paid plan applies, its price and billing terms will be confirmed with your organization in writing before any charge, and any payments processed through Razorpay are additionally subject to Razorpay's own terms.

7. Service availability

We aim to keep the Service available and reliable but don't guarantee uninterrupted access. We may perform maintenance, and features that depend on a third-party provider can be affected by that provider's own downtime.

8. Limitation of liability

To the maximum extent permitted by law, ScaleNova CRM is provided "as is," and we are not liable for indirect, incidental, or consequential damages arising from your use of the Service.

9. Termination

You may stop using the Service and close your organization's account at any time (see Data & Account Deletion). We may suspend or terminate access for a violation of these Terms.

10. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, and any dispute will be subject to the exclusive jurisdiction of the courts of India.

11. Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date above, and for material changes, we'll make a reasonable effort to notify organization admins directly.
